By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Eligibility
1.1 Age Requirements
To create an account and use the Service, you must be:
- At least 18 years old, OR
- At least 13 years old with parental or guardian consent
The Service is designed for use by parents/guardians with their children ages 3-12.
1.2 Parental Supervision
Children under 13 may only use the Service under direct parental supervision and after we have obtained verifiable parental consent.
2. Account Registration
You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of unauthorized access
3. Parental Consent for Children
3.1 COPPA Compliance
Our Service complies with the Children's Online Privacy Protection Act (COPPA). Before we collect any personal information from or about a child under 13, we require verifiable parental consent.
3.2 Consent Process
- A parent or guardian must have an account
- The parent must provide their email address
- We will send a consent email explaining what data is collected
- The parent must click the verification link within 48 hours
- Only after verification can the child's profile be created
4. Description of Service
4.1 What We Offer
Your Bedtime Story is an AI-powered application that:
- Generates personalized bedtime stories featuring the user's child
- Provides text-to-speech narration of stories
- Offers ambient sound options (rain, ocean, forest)
- Stores story history for playback
- Supports multiple languages

5. Subscription and Payment
5.1 Billing
Subscriptions are billed monthly in advance at $9.99 per month. Payment is processed by Paddle, our merchant of record.
5.2 Automatic Renewal
Subscriptions automatically renew until cancelled. You will be charged within 24 hours before the end of each billing period.
5.3 Cancellation
You may cancel your subscription at any time:
- In the app under Settings > Subscription
- Through your app store subscription settings
- By contacting support@yourbedtimestory.com
Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until the end of your paid period.
5.4 Refund Policy
Subscriptions are billed in advance for each monthly period. No refunds or credits will be provided for:
- Partial months or unused subscription time
- Account deletions
- Downgrade from Premium to Free tier
- Failure to use the Service during an active subscription
When you delete your account, your subscription will be canceled at the end of the current billing period. You will not receive a refund for any remaining time in your billing cycle.
5.5 EU/UK Consumer Rights - Right of Withdrawal
Under EU and UK consumer protection law, you have a 14-day right of withdrawal (cooling-off period) from the date of your initial subscription purchase.
Waiver of Right of Withdrawal: When you subscribe to Premium, you will be asked to confirm that you want immediate access to the Service. By checking this box, you expressly consent to the immediate performance of the Service and acknowledge that you lose your 14-day right of withdrawal once your subscription begins and you start using Premium features.
If you do not check this box, you cannot complete your subscription purchase. This ensures you understand your rights before proceeding.
To request a refund within 14 days (if you have not waived this right): Contact support@yourbedtimestory.com with your account email and reason for refund.
6. User Conduct
6.1 Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms.
6.2 Prohibited Conduct
You agree NOT to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access
- Submit story topics that are violent, sexual, or inappropriate for children
- Create false or misleading accounts
- Share your account with others
- Use automated systems (bots, scrapers) without permission
6.3 Content Guidelines
Story topics must be:
- Age-appropriate for children
- Free of violence, horror, or scary themes
- Free of sexual or mature content
- Respectful and positive
7. AI-Generated Content
7.1 How Stories Are Generated
Our Service uses artificial intelligence to generate personalized bedtime stories using OpenAI GPT models for text and OpenAI TTS or Google for voice synthesis.
7.2 Content Ownership
You have a license to use stories generated for your account for personal use. You may not resell or commercially distribute generated stories.
7.3 No Guarantee of Originality
AI-generated content may contain similarities to other generated content and may not be eligible for copyright protection in some jurisdictions.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
The Service is for entertainment purposes only. It is NOT:
- Medical advice
- Sleep therapy
- Treatment for sleep disorders
- A substitute for professional medical care
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
- The amount you paid us in the 12 months before the claim, OR
- $100
10. Termination
10.1 Termination by You
You may terminate your account at any time by using the "Delete Account" feature in Settings or contacting support.
10.2 Termination by Us
We may suspend or terminate your account at any time, with or without cause, including if we believe you have violated these Terms.
